Red Rift, Inc does not assume responsibility for the accuracy, reliability, or legality of any content created or shared through the Service.

By accessing or using the Service, you agree to these Terms in full. If you do not agree with any part of these Terms, you must immediately cease using the Service.

3. No Warranties & Content Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, Red Rift, Inc makes no representations, warranties, or guarantees of any kind, whether express or implied, regarding:

5. User Responsibilities & Prohibited Conduct

a. Eligibility

7. Intellectual Property

Red Rift, Inc retains ownership of the platform, algorithms, design, and branding used in the Service.

a. Platform Ownership

All intellectual property rights related to HyperPresent.ai, including but not limited to software, code, algorithms, features, design, and branding elements, are the exclusive property of Red Rift, Inc.

b. User-Generated Content

You retain ownership of any content you submit to or create through the Service, subject to the licenses granted below.

c. Commercial Usage Rights

Red Rift, Inc grants you the following rights regarding presentations and materials created using the Service:

• Paid subscribers may use, distribute, modify, and sell materials created using the Service for commercial or non-commercial purposes with no royalty obligations to Red Rift, Inc.
• Free users may use, distribute, modify, and sell materials created using the Service, but must include clear attribution to "Created with HyperPresent.ai" when distributing or publishing such materials.
• All users are prohibited from claiming intellectual property rights to the HyperPresent.ai platform itself or misrepresenting materials created using HyperPresent.ai as having been created independently.

d. Feedback and Suggestions

Any feedback, suggestions, ideas, or recommendations you provide regarding the Service are given freely, and Red Rift, Inc has the right to use and implement such feedback without obligation or restriction.

8. Subscriptions, Credits & Refund Policy

a. Subscription Terms

HyperPresent.ai offers various subscription plans that provide a defined number of generation credits for use during each billing cycle. By purchasing a subscription, you agree to the following terms:

• Subscriptions are billed either monthly or annually, as selected at the time of purchase.
• Your subscription will automatically renew at the end of each billing period unless cancelled prior to the renewal date.
• You are responsible for maintaining accurate billing information and ensuring sufficient funds are available for renewal charges.
• Subscription fees are subject to change with notice prior to your next billing cycle.

b. Credits System

Generation credits function as follows:

• Credits are allocated to your account upon successful subscription payment.
• Credits have defined expiration periods as specified in your subscription plan details.
• Credits are non-transferable and non-refundable once allocated to your account.
• Credits that are unused at the time of subscription cancellation or expiration are forfeited.
• Red Rift, Inc reserves the right to modify the credit system, including credit values, allocation, and expiration terms, with prior notice.

c. Cancellation

You may cancel your subscription at any time through your account settings or by contacting our support team. However:

• Cancellation will take effect at the end of your current billing cycle.
• You will retain access to your subscription benefits until the end of the current billing period.
• No partial refunds will be issued for the unused portion of a billing cycle.
• You are responsible for cancelling your subscription before the next renewal date to avoid being charged.

d. Refund Policy

Our refund policy is as follows:

• All subscription purchases are final and non-refundable once any credits have been used during the billing cycle.
• For monthly subscriptions, we may offer a pro-rated refund only if no credits have been used and the cancellation request is made within 24 hours of the purchase.
• For annual subscriptions, we may offer a prorated refund only if no credits have been used and the cancellation request is made within 5 days of the purchase.
• Technical issues or service interruptions do not automatically qualify for refunds. We will work to resolve such issues and may offer compensation in the form of additional credits at our sole discretion.
• Abuse of our refund policy, including multiple subscription purchases and cancellations, may result in denial of future refund requests or account termination.
• All refund requests must be submitted in writing to support@hyperpresent.ai and include your account information and reason for the refund request.
• Red Rift, Inc reserves the right to make the final determination on all refund requests.

e. Fraud Prevention

To protect against fraudulent activity:

• Red Rift, Inc reserves the right to verify the identity of subscribers and their payment methods.
• Accounts suspected of fraudulent activity or abuse of our subscription system may be suspended or terminated without prior notice and without refund.
• Multiple refund requests from the same user or payment method may trigger a fraud review.
• Attempting to circumvent payment systems, credit limitations, or subscription terms is strictly prohibited and may result in legal action.

f. Price Changes

Red Rift, Inc reserves the right to modify subscription pricing at any time. If the subscription price changes, we will notify you before your next billing cycle. By continuing to use the Service after a price change takes effect, you agree to pay the updated price.

9. Indemnification

By using the Service, you agree to defend, indemnify, and hold harmless Red Rift, Inc, its affiliates, employees, contractors, officers, and directors from any and all claims, liabilities, damages, costs, and expenses (including legal fees) arising from:

• Your use of the Service.
• Your reliance on third-party content.
• Any violation of these Terms.
• Any disputes with third-party news providers.

10. Modifications & Termination of Service

We reserve the right to modify, update, suspend, or discontinue the Service at any time, without prior notice or liability. We are not responsible for any interruptions or changes to the availability of third-party content.

11. Governing Law & Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the Michigan, United States, without regard to conflict of law principles.

Any disputes arising from these Terms shall be resolved exclusively in the appropriate courts within Michigan, United States.
